Information on processing of personal data in accordance with article 13 of Italian Legislative Decree 196/03 on the protection of personal data
Dear User,
Under article 13 of the law on the protection of personal data (Italian Legislative Decree 196/03) this section provides information regarding the processing of your personal data by [GEFRAN S.p.A.] to supply the services required.
1) All personal data received during registration to receive the services supplied by [GEFRAN S.p.A.] or collected later while using said services, will be used by [GEFRAN S.p.A.] for the purposes of communication and/or fulfilment of the contract with registered service users.
Your personal data will be processed by [GEFRAN S.p.A.] with the aid of computerised, ITC and printed paper means.
We will not disclose or transmit the data stored in our database to third parties but such data may be used by officials at the offices of [GEFRAN S.p.A.] (including the Credit Recovery, Legal and Customer Care offices) entrusted to perform such activities.
In accordance with current legal requirements, pursuant to Legislative Decree 196/03 and subsequent additions and amendments, data relating to ITC traffic (data relating to location and internet connections - known as log files ) will be kept for six (6) months for the purpose of billing activities or collection of payments (in case of paid services), as envisaged under section 123 of the aforesaid Legislative Decree 196/03 and subsequent additions and amendments. This period starts from the date on which the invoice falls due. 
The provision of your personal data is mandatory for the above-mentioned purposes; in the case of missing, partial or incorrect data, it may be impossible to supply the required services. 
2) Subject to your explicit consent and until said consent is revoked, your personal data may be processed either directly or through third parties, even through one or more distance communication techniques (e-mail, telephone, automated call systems without an operator or fax) - besides the purposes set out in paragraph 1) also for purposes which are not strictly connected to the supply of the required services, in other words for: 
a) eventuale assunzione presso le strutture ricettive associate
b)SMS, e-mails and/or telephone calls concerning advertising material and commercial information;
c) direct and indirect sales and placement activities through various retail channels;
d) interactive sales information;
e) surveys concerning customer satisfaction on the quality of the services supplied (even through third parties);
f) promotional initiatives regarding products and/or services of other companies;
g) surveys and market research.
Consent for processing and the purposes as set out in paragraph 2) above is not obligatory; should you refuse [GEFRAN S.p.A.] will only keep your data for the purposes listed in paragraph 1).
The data processing specified in paragraphs 1) and 2) above may be performed using printed or computerised and/or ITC media and in any case using methods and procedures such as to guarantee conformity with the applicable regulations.
Your personal data will be processed within [GEFRAN S.p.A.] by Customer Care, Sales, Marketing, Invoicing and Technology staff. Such staff, who operate under the direct authority of the respective "data processing controller", have been appointed as data processing officials and have received special operational instructions.
Besides [GEFRAN S.p.A.] employees, some of your personal data may be processed by third parties, based in Italy and/or abroad, to whom [GEFRAN S.p.A.] entrusts some (or a portion) of the activities pertinent to the supply of the above-mentioned services. In that case, they operate as independent data controllers or are appointed as data processing controllers or officials. Any appointed data processing controllers or officials will receive suitable operational instructions, with particular reference to the adoption of minimum safety measures in order to guarantee confidentiality and safety of data. The above-mentioned third parties are essentially included in the following categories: credit recovery firms, billing data processing companies, companies appointed to print and send invoices to customers, consultancy firms, credit transfer companies, companies performing telemarketing and call centre activities, agents and brokers, franchisees.

You may, at any time, exercise your rights under article 7 of the law on the protection of personal data, which is included below for your information. Said rights must be exercised in writing and addressed to:

"Article 7 Right of access to personal data and other rights	
1. The data subject shall have the right to obtain confirmation as to the existence of personal data concerning him/her, regardless of its being already recorded, and communication of such data in an intelligible form.
2.The data subject shall have the right to be informed:
a) of the source of the personal data;
b) of the purposes and methods of its processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification details concerning the data controller, data processors and the representative designated in Italy, where envisaged;
e) of the entities or categories of entity to whom or which the personal data may be communicated and who become aware of said data in their capacity as designated representative in the Italian State's territory, data processors or persons in charge of processing.
3.The data subject shall have the right to obtain
a) updating, correction or, where interested therein, integration of the data;
b) erasure, anonymisation or blocking of data that has been unlawfully processed, including data whose retention is unnecessary for the purposes for which it was collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified as also related to their contents, to the entities to whom or which the data was communicated or divulged, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. The data subject shall have the right to object, in whole or in part:
a) on legitimate grounds, to the processing of personal data concerning him/her, even though it is relevant to the purpose of collection;
b) to the processing of personal data concerning him/her, where this is performed for the purpose of sending advertising material, making direct sales or conducting market or commercial communication sales."
